1. ACCEPTANCE OF TERMS
By accessing and using the Photonik platform (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. ACCOUNT TERMS
2.1 Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.
2.2 Account Responsibility
You are responsible for all activities that occur under your account. You must immediately notify Photonik at cleanenergyreviews@gmail.com of any unauthorized use of your account.
2.3 Account Termination
Photonik reserves the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
3. USE OF SERVICE
3.1 Permitted Use
You may use the Service for lawful business purposes related to solar design, energy planning, and proposal generation.
3.2 Professional Advice Required
The Service provides tools and calculations only. You must obtain independent professional advice from qualified installers, engineers, and financial advisors before making any solar installation decisions. Photonik does not provide professional solar design services or financial advice.
3.3 Prohibited Activities
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service without permission
- Copy, modify, or distribute any content from the Service without authorization
- Misrepresent your identity or affiliation with any person or organization
4. DISCLAIMER & LIMITATIONS
4.1 Calculation Accuracy Disclaimer
THE CALCULATIONS, ESTIMATES, AND DATA PROVIDED BY THE PHOTONIK SERVICE ARE PROVIDED "AS IS" AND ARE BASED ON VARIOUS ASSUMPTIONS, ESTIMATES, AND THIRD-PARTY DATA SOURCES. PHOTONIK MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CALCULATIONS OR ESTIMATES PROVIDED THROUGH THE SERVICE.
4.2 Solar System Performance Estimates
Solar energy generation estimates, savings calculations, and performance projections are estimates only and may vary significantly from actual results. Actual performance depends on numerous factors including but not limited to:
- Local weather conditions and climate patterns
- Shading from trees, buildings, or other obstacles
- Roof orientation, tilt, and condition
- Equipment performance and degradation over time
- Installation quality and system configuration
- Local grid conditions and utility policies
- Energy consumption patterns
- Maintenance and cleaning
4.3 Financial Estimates
Cost estimates, savings projections, payback periods, and financial analyses are estimates only and are not guarantees of actual costs or savings. Actual costs and savings may vary significantly due to:
- Site-specific installation requirements
- Local labor and material costs
- Permitting and inspection requirements
- Utility connection fees and requirements
- Changes in government incentives or rebates
- Changes in energy tariffs and rates
- Equipment price fluctuations
- Local market conditions
4.4 Third-Party Data
The Service relies on third-party data sources for weather information, solar irradiance data, government rebate programs, energy tariffs, and other information. Photonik is not responsible for the accuracy or availability of third-party data.
4.5 No Warranty
PHOTONIK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
4.6 User Responsibility
You acknowledge and agree that:
- You must independently verify all calculations and estimates before making any decisions
- You are solely responsible for decisions made based on information from the Service
- You should consult with qualified professionals (installers, engineers, financial advisors) before proceeding with any solar installation
- Photonik is not responsible for any losses or damages resulting from your use of the Service
- You are responsible for ensuring compliance with all local laws, regulations, and building codes
5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHOTONIK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of or inability to use the Service
- Any unauthorized access to or use of our servers and/or personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
- Any errors or omissions in any content or for any loss or damage incurred from use of any content posted, emailed, transmitted, or otherwise made available through the Service
PHOTONIK'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO PHOTONIK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 AUD), WHICHEVER IS GREATER.
6. INTELLECTUAL PROPERTY
6.1 Service Content
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, images, software, and calculations, are owned by Photonik or its licensors and are protected by copyright, trademark, and other intellectual property laws.
6.2 User Content
You retain ownership of any content you create using the Service, including solar designs, proposals, and customer data. By using the Service, you grant Photonik a non-exclusive, royalty-free license to use, store, and process your content as necessary to provide and improve the Service.
6.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant Photonik the right to use such feedback without any obligation to you.
7. PRIVACY
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. INSTALLER MARKETPLACE (IF APPLICABLE)
If you use the Service to connect with solar installers:
- Photonik acts as a platform only and is not responsible for the quality, safety, or legality of services provided by installers
- All contracts for solar installation are directly between you and the installer
- Photonik does not endorse or guarantee any installer
- You should conduct your own due diligence before engaging any installer
9. MODIFICATIONS TO TERMS
Photonik reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
10. MODIFICATIONS TO SERVICE
Photonik reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Photonik shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
11. AUSTRALIAN CONSUMER LAW
If you are an Australian consumer, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded, restricted, or modified under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law.
To the extent permitted by the Australian Consumer Law, our liability for breach of a consumer guarantee is limited to, at our option:
- For goods: replacement, repair, or payment of the cost of replacement or repair
- For services: re-supply of services or payment of the cost of re-supply
12. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
13. DISPUTE RESOLUTION
Before commencing any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at cleanenergyreviews@gmail.com.
14. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
